myTempo is a software application (“Application” or “App”) tool created by Lilly USA, LLC (“Lilly” or “we” or “us”) for use on mobile devices. The tool is designed to allow you to log your diabetes-related data, to aid in your diabetes management. myTempo is not intended to replace the care provided by a licensed healthcare practitioner or to provide any treatment or diagnosis.
This Privacy Statement applies to your use of myTempo and the information that we collect and use about you when you download, register, and interact with the myTempo Application. We refer to the information that we collect about you pursuant to this Privacy Statement as “your information.”
Specifically, when you register with us to use the Application, you will need to enter the following information about yourself:

The sources that provide us information may also include your insurer, physician/healthcare practitioner team. For example, we may receive information such as your gender, laboratory results, and other medications you may be taking. We generally have your authorization to obtain your information from these sources.
This Privacy Statement does not apply to information that we obtain subject to an agreement with your insurer, physician/healthcare practitioner team. Such information is subject to any restrictive terms in the relevant agreement and should not be considered “your information” for purposes of this Privacy Statement.
Your information may be combined to help us enhance and improve our products and services and tailor our communications.
Your information will be saved for a period of time needed to fulfill legitimate and lawful business purposes in accordance with our record-retention policies and applicable laws and regulations.
We endeavor to provide physical, electronic, and procedural safeguards to protect information that we maintain. Please be aware that, although we endeavor to provide reasonable security for information we work with and maintain, no security system can prevent all potential security breaches.
We do not use the Application to knowingly collect data from or market to patients under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at 1-800-LillyRx (1-800-545-5979).
Upon verification of your identity and as applicable by law, you have the right to request information from us on how your PI is being used and with whom it is being shared. Information about our process to verify your identity can be found HERE. You also have the right and choice to request to see and receive a copy of the PI that we have about you, request that we correct, restrict the processing of, and/or erase/delete your PI, or in France, set expectations for the handling of your data after your death.
In limited circumstances, you may have the right to have your information transmitted to another entity or person in a machine-readable format.
There may be exceptions that apply to your request.

California Privacy Rights
California Civil Code Section 1798.83 entitles California residents who have an established business relationship with Lilly the right to request information regarding Lilly’s disclosure of certain PI to third parties for their direct marketing purposes. To make a request for such information, you may contact us using the information in the “How to Contact Us” section below.
California Consumer Privacy Act (CCPA) entitles California residents to certain rights with regard to their PI. Those rights have been incorporated into this Privacy Statement.

How to Submit a Complaint
If you wish to raise a complaint on how we have handled your PI, you can contact our Data Protection Officer at privacy@lilly.com, who will investigate the matter.
If you are not satisfied with our response or believe we are not processing your PI in accordance with the law, you can register a complaint with a relevant regulatory authority (e.g., a Data Protection Authority or Attorney General).

We will always handle your PI in accordance with the Privacy Statement in effect at the time it was collected unless we provide you with the new notice and/or obtain your consent, as appropriate.
You can stop the collection of your information from the Application by uninstalling the Application via the standard uninstall processes.
Please note that deleting the Application will prevent the collection of new information; however, previously collected information will remain with Lilly, your insurer, your physician/healthcare practitioner team, and Lilly’s vendors, suppliers, contractors, and business partners. In order to remove your previously collected information from Lilly, please contact 1-800-LillyRx (1-800-545-5979) or send an email to privacy@lilly.com. Please note that Lilly may be required to retain some or all of your information for a certain period of time as required by applicable law or to protect our business and legal interests.
By downloading and using this Application, you are consenting to our processing of your information as set forth in this Privacy Statement now and as amended by us. "Processing” means using information in any way, including, but not limited to, collecting, storing, deleting, using, combining, and disclosing information, all of which activities will take place in the United States. If you reside outside the U.S., your information will be transferred to the U.S., and processed and stored there under U.S. privacy standards, which may not be as protective as laws in the country where you reside.
